What is the new Seller Disclosure Statement?

Since 1 August 2025, every seller in Queensland must provide a Disclosure Statement (Form 2) to the buyer before signing the contract. It includes important searches and certificates. At Kiefa Conveyancing, we prepare this for you as part of our fixed fee.

Do I need a solicitor to sell my property in QLD?

Yes. A solicitor prepares and reviews your contract, ensures you meet the new disclosure requirements, handles settlement, and protects you against legal and financial risks.

How much are conveyancing fees when selling?

Accepted Answer

Our professional fee is fixed at Kiefa Conveyancing - no hidden extras. You’ll just need to pay for the required searches for the Disclosure Statement (usually $200–$800 depending on property type).

Do I need to provide a pool safety certificate?

Accepted Answer

Yes, if the property has a pool, you must provide either a current Pool Safety Certificate or a Notice of No Pool Safety Certificate with the contract.

Do I need to arrange smoke alarm compliance?

Accepted Answer

Yes. From 1 January 2022, QLD law requires all properties sold to comply with the new smoke alarm standards. Compliance must be confirmed before settlement.

When does the buyer take responsibility for insurance?

Accepted Answer

In QLD, the buyer takes on the risk of the property from 5:00 pm the next business day after the contract is signed. However, we still recommend you maintain your insurance until after settlement has completed.

What happens with my mortgage?

If your property has a mortgage, we’ll arrange with your bank to discharge it at settlement. It’s important to notify your bank as soon as possible to avoid delays.

Do I need to move out before settlement?

Yes. Unless otherwise agreed, you must provide vacant possession by settlement time. This means the property needs to be fully vacated and cleaned, with all keys handed over.

How long does settlement take?

Standard settlement in Queensland is 30 days, but it can vary depending on the contract.

What happens on settlement day?

Accepted Answer

We coordinate with your bank, the buyer’s solicitor, and PEXA to complete the transfer of funds and title. Once settlement is finalised, the buyer’s agent will hand over the keys.
